Subject: Urgent Recommendation: Relinquishment of National Government Control over Aircraft Accident Investigations and Searches to an Independent International Body (ICAO) – Lessons from the MH370 Disappearance
Dear ICAO Leadership,
The prolonged and unresolved search for Malaysia Airlines Flight MH370, which vanished on 8 March 2014 with 239 souls on board, stands as a stark indictment of the current system of aircraft accident investigation and recovery. Fragmented national oversight, conflicting state interests, restricted data access, and inconsistent funding have left families without answers, the aviation industry without definitive lessons, and the public without confidence in the process. More than twelve years later, the absence of closure continues to inflict profound pain on those left behind.
It is therefore proposed that sovereign governments immediately and formally relinquish primary control of all large-scale aircraft accident investigations and oceanic or remote searches to an independent, supranational body – the ICAO – operating irrespective of the aircraft’s state of registration, operator, or manufacturer. This transfer of authority would remove political, commercial, and diplomatic impediments that have repeatedly compromised objectivity in high-profile cases such as MH370.
To fulfil this mandate, the ICAO must be vested with the following non-negotiable powers and responsibilities:
I respectfully request that the ICAO convene an urgent high-level working group, inclusive of family representatives from MH370 and other major incidents, to draft the necessary international legal framework for submission to ICAO and the United Nations. I stand ready to provide any further supporting material or to participate in such deliberations.
The time for incremental change has passed. The families of MH370 – and the travelling public worldwide – deserve a system that places truth, accountability, and human dignity above all else.

- Full Transparency from Commencement to Conclusion
All phases of investigation, search, data analysis, and decision-making shall be conducted in real time (subject only to narrowly defined national-security redactions) and made publicly accessible via a secure, permanent online portal. - Thorough, Independent Accident Reports Subject to Public Scrutiny and Input
Final reports shall be drafted by ICAO-appointed experts and released in draft form for a minimum 90-day period of global public and expert commentary before adoption. All stakeholder submissions shall be published verbatim alongside the final report. - Financial Guarantees for Complete Investigation and Recovery
The ICAO shall have statutory authority to secure and disburse all necessary funds without reliance on voluntary contributions from involved states or parties. No investigation or search shall be suspended or scaled back for budgetary reasons. - Continuous and Compassionate Liaison with Families of the Lost
A dedicated Family Liaison Directorate shall provide regular, culturally sensitive updates, psychological support, and direct participation rights (including observer status at key briefings) to next-of-kin throughout the process and beyond. - Establishment and Management of an Independent Aircraft Accident Investigation and Search Fund
The Fund shall be capitalised by a modest, globally uniform levy (for example, US$1–2 per international airline ticket) collected automatically at point of sale and administered exclusively by the ICAO under strict fiduciary oversight and annual independent audits. Proceeds shall be ring-fenced solely for investigations, searches, and family support.
- Mandatory Global Cooperation Protocol
All member states, airlines, aircraft manufacturers, satellite operators, and military authorities shall be legally bound (via treaty or convention) to provide immediate, unrestricted access to raw data, wreckage, and personnel. - Conflict-of-Interest Safeguards
Automatic exclusion of any state, airline, or manufacturer with direct involvement from leadership or voting roles in the specific investigation. - Advanced Technological Mandate
Authority to deploy and fund cutting-edge search and recovery technologies, including autonomous underwater vehicles, satellite constellation enhancements, and AI-driven debris drift modelling. - Whistle-blower Protection and Legal Immunity
Robust mechanisms to protect individuals disclosing critical information, coupled with legal immunity for ICAO personnel acting in good faith. - Periodic Independent Review
The ICAO’s own performance shall be subject to external audit every three years by a rotating panel of internationally respected jurists and safety experts.
